Description
Konsorsium Pembaruan Agraria works on agrarian issues with a focus on protection and recognition of indigenous peoples' customary land rights; promotion of land reform as a precondition for development; and establishment of dispute resolution mechanisms that accommodate the interests of indigenous peoples and small landholders. KPA leads the NGO movement on agrarian reform as facilitator and information disseminator. It has provided vital data to others to help resolve land disputes at the local level. It has produced analyses of draft agrarian reform laws and the rights of indigenous peoples over land; journals on agrarian reform and indigenous peoples issues; as well as manuals on agrarian reform and farmer organizing.

In this grant, KPA has the following objectives:

1) Train 20 regional NGO activists as KPA regional facilitators to handle land disputes and increase their understanding of comprehensive agrarian reform; and

2) Improve the KPA information resource system to support work of the regional facilitators.

Training of regional facilitators. KPA will conduct an assessment in at least ten regions in collaboration with local NGOs and KPA partners. This process will produce (1) a description of land disputes addressed by NGOs; (2) an assessment of NGO initiatives to address the land disputes; and (3) list of possible candidates for training. KPA core team will develop a training curriculum on the basis of existing materials and experience in agrarian disputes, as well as the results of the assessment. The objective of the training course is to provide participants with a clear vision for agrarian reform and improve skills to handle land disputes. It will also offer tools for dispute management. Participants will have the opportunity to reflect on their experiences and develop effective social actions. They will produce a fieldwork plan and then apply their knowledge and training with local communities, regional NGOs and others involved with KPA's reform agenda. They will each produce a report on relevant activities and analysis of agrarian conditions, land disputes and NGO initiatives for their region. KPA will monitor them on the basis of these reports, and support them with information from the KPA information resource system. By the end of ten months, KPA will conduct a participatory evaluation and writing workshop to get feedback on effectiveness of the course and to finalize reports. The report describing patterns of land disputes in Indonesia and NGO initiatives to resolve them, will be published.

KPA information resource system. KPA's executive body has a special division that supplies and packages information. It has published two journals, four books, various memoranda and position papers on land disputes and is accessible in the internet. In this project, KPA expect to better address increasing demand from local communities for information through the KPA regional facilitator. This information will be vital to help increase communities' bargaining positions in land disputes. A workable system of information storage, processing and dissemination will be established.

Results

During this project, KPA was able to scope land and tenure conflict patterns in 17 provinces, assess local ability to handle these conflicts, and used the information to develop a learning curricula for conflict management that focuses on agrarian related disputes. They trained two batches of trainers, who now add up to 47 agrarian conflict facilitators, 28 from Sulawesi, and 19 from other regions in Indonesia. KPA decided to focus training of facilitators in Sulawesi after its first workshop showed the need for intensive interaction among facilitators in order for them to be effective. They found that the closer the field-areas are, the better chances are for cross-facilitation and cross-community learning. Sulawesi was agreed as the priority region due to the number of potential land related conflicts in the area; the scarcity of well-trained facilitators; and activists in the area were considered to be limited in their experience in organizing and rights analysis.

KPA developed a training manual that includes information on the root problems of land use conflicts, and emerging lessons learned so far from these conflicts. The manual also supplies exercises for building specific skills to improve organizational capacity, set up networking and protocols for communications, and building up grassroots' movements.

The trained regional facilitators now conduct activities in their respective regions with their own organizations. These activities include information dissemination on land disputes, direct actions in dealing with actual agrarian conflicts, workshops with local actors on issues underlying agrarian conflict, and developing local community initiatives in resource planning as a means of dealing with agrarian conflicts. A list of KPA regional land dispute facilitators is now available.

KPA and its local facilitators also engage regional and national government in agrarian reform negotiations using a database developed from this project. KPA's decentralization training initiative uses not only the database but also the networks developed among NGOs and local governments in the regions. A plan to draft an agrarian reform law is currently being studied by the national parliament which uses the analysis provided by KPA in collaboration with the Land Registration Agency.

A special edition of the "Suara Pembaruan Agraria" newsletter reflects learnings of participants from the trainings. Two other manuals, on conflict resolution over natural resources, and working with adat communities are now available.
